The Dangers of Running an Uncertified EWP in the ACT

For ACT contractors and building managers, a clear-eyed look at why an uncertified or poorly maintained elevating work platform is a machine you cannot vouch for, and what that means when a boom fails without warning.

In the ACT, access equipment tends to work on facades, fit-outs and infrastructure where the platform is over public space, over trades below, or high against a building. That setting sharpens the stakes: a structural failure is not only a danger to the operator but to everyone in the drop zone. Yet the fault that would cause it is usually invisible on the day, which is the whole problem with running a machine whose certification has lapsed. This guide explains how such a failure develops, why it cannot be seen coming, and how WorkSafe ACT frames the responsibility. What certification actually certifies

It is easy to read certification as a compliance formality. It is better understood as a statement of fact: a competent person has checked this platform against the way it was designed to be built, under AS/NZS 1418.10, and the way it must be kept in safe use, under AS 2550.10, and found it fit to lift a person. Current certification means that statement still holds.

When it lapses, the statement expires with it. The machine has not automatically become unsafe, but the assurance that it is safe has gone — and for a platform working above other people, an owner who cannot vouch for the structure is carrying a risk they cannot see or size.

The anatomy of a hidden crack

Booms are engineered to flex under load, and that flexing is concentrated at particular points: the toes of welds, the pivots where the boom articulates, holes, and places where one section meets another. Those are the points where fatigue does its work.

A fatigue crack starts small at one of those stress-raisers and lengthens by an imperceptible amount on each work cycle. Because it grows beneath the surface or under coatings, the member looks unchanged the entire time. The steel keeps carrying the load right up until the intact metal around the crack runs out, and only then does it fail — abruptly, and without the warning signs people expect from something about to break.

Why a pre-start check will not catch it

A conscientious operator's pre-use inspection is valuable for the faults it is designed to catch, but fatigue cracking is not among them. The cracks that bring a boom down are sub-surface or paint-covered, and no visual check reaches them.

This is why the inspection framework escalates into a major inspection — falling due at five years or ten years depending on the equipment class — in which critical welds and members are opened up and non-destructive testing is used to find what the eye cannot. That teardown is the only reliable way a hidden crack becomes a known, measured defect. A platform running without current certification has bypassed that safeguard entirely.

How neglect stacks the odds

Deferred maintenance is rarely a single act; it is a series of small postponements that each seem harmless. Together they change the machine's condition in ways that make a serious failure more likely, not less.

A machine left to drift tends to collect:

  • Untreated corrosion that both thins structural members and creates the notches where fatigue cracks initiate.
  • Worn pins, bushes and bearings that add slack and push higher loads through the joints of the structure.
  • Deferred repairs to hydraulic circuits and safety devices, so an interlock or emergency lowering may not work when it is finally needed.
  • An incomplete logbook, leaving the next inspector and any prospective buyer without a trustworthy history to judge the machine by.

A failure over occupied ground

Stated plainly, when a boom or basket structure lets go while a worker is elevated, there is nothing left to arrest the outcome. In an ACT context, where platforms frequently operate above public areas and other trades, the consequences of that instant are not confined to the person on the machine.

The certification and inspection regime exists to make sure that instant never arrives — to find and fix the fault while it is still steel to be tested, not an event to be investigated. Running uncertified removes the one layer built specifically to do that.

WorkSafe ACT and the duty in play

The ACT operates under the harmonised model work health and safety laws, and WorkSafe ACT is the regulator. The duty is expressed as an outcome: a business must ensure, so far as is reasonably practicable, that plant its workers use is safe. A platform whose safety cannot be shown does not satisfy that, regardless of how it performs on an ordinary day.

Following a serious incident, WorkSafe ACT can investigate, and the platform is stood down while its certification and maintenance are examined. The recurring questions — was it certified, was it maintained, can that be proven — are also the ones that tend to govern how contracts and insurance respond.

Restore certainty before it is tested for you

An uncertified machine can be brought back to a known state. An independent inspection establishes its real condition, puts its records in order and catches a developing fault while it remains a repair rather than an incident.
